A. Each manager of a sexually oriented business and each performer in a sexually oriented business must annually obtain and maintain a separate license; provided, however, each performer must only obtain one performer’s license annually from the city.

B. An applicant must be qualified according to this chapter. The application form may request and the applicant shall provide such information including, but not limited to, at the department’s sole discretion, fingerprints, as will enable the department to determine whether the applicant meets the qualifications established in this chapter. In the event that the department requires an applicant to submit fingerprints as part of the application process, the applicant shall obtain such fingerprints independently and at his or her sole expense.

C. An application for a manager’s license or performer’s license must be made on a form provided and adopted by the department. The completed application for a sexually oriented business manager’s or performer’s license must contain or be accompanied by the following information and documents:

1. The applicant’s name or any other name, including stage names or aliases, used by the individual;

2. Age, date and place of birth;

3. Height, weight, hair and eye color, and other identifying marks;

4. Present residence address and telephone number;

5. Present business address and telephone number;

6. Date, issuing state, and number of driver’s permit or other identification card information;

7. Proof that the individual is at least eighteen years of age; and

8. Name and address of the sexually oriented business at which the individual will perform.

D. Attached to the application form for a manager’s or performer’s license must be the following:

1. A color photograph of the applicant clearly showing the applicant’s full face. The applicant shall also provide fingerprints certified by a Washington municipal or state law enforcement agency. The applicant shall obtain such fingerprints independently and at his or her sole expense;

2. A statement detailing the license history of the applicant for the five years immediately preceding the date of the filing of the application, including whether the applicant, in this or any other county, city, state, or country, has ever had any occupational, professional or other employment-related license, permit, or authorization to do business denied, revoked, or suspended, or had any professional or vocational license or permit denied, revoked, or suspended. In the event of any such denial, revocation, or suspension, the applicant must state the name, the name of the issuing or denying jurisdiction, and describe in full the reason for the denial, revocation, or suspension. A copy of any order of denial, revocation, or suspension must be attached to the application; and

3. A statement whether the applicant has been convicted of specified criminal activity and, if so, the specified criminal activity involved, the date, place, and jurisdiction of each offense. (Ord. 029/2003)
