Whenever a person congregates with four or more other persons:

A. With intent to commit any unlawful act by force;

B. With intent to carry out any purpose in such manner as to disturb the public peace; or

C. Being assembled, participates in an attempt or in threats of any act(s) tending towards a breach of the peace, or an injury to persons or property or any unlawful act; such assembly is unlawful, and every person participating therein by his presence, aid or instigation is guilty of a misdemeanor; provided, that prior to making arrests, a public safety order to disperse, move or refrain from specified activities in the immediate vicinity is given and a reasonable time is allowed for such dispersion.
